Delivery Specifics: In the case of weather which inhibits the ability to make safe deliveries, or other events beyond our control that interfere with our ability to deliver your order, we will attempt to deliver your Comanche Compost Co. Order as soon as reasonably possible. In some cases, delivery may occur on a date other than your scheduled delivery day. If the delivery of your Comanche Compost order is not feasible, we will cancel your delivery for the period so affected and issue you a credit, as determined in our sole discretion or refund of a part or the whole of the purchase price for that invoice issued.
Force Majeure: We will not be liable or responsible for any failure to perform, or delay the performance of, any of our obligations that is caused by events outside our reasonable control (“Force Majeure Event”). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes, but is not limited, to the following: (1) Strikes, lock-outs, or other industrial action; (2) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war, or threat or preparation for war; (3) Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or other natural disaster; (4) Impossibility of the use of railways, shipping, aircraft, motor transport, or other means of public or private transport; (5) Impossibility of the use of public or private telecommunications networks; and (6) The acts, decrees, legislation, regulations, or restrictions of any government. Our performance under this Agreement is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable efforts to bring the Force Majeure Event to a close or to find a solution by which our obligations under this Agreement may be performed despite the Force Majeure Event.
Receipt of the materials and Grow Box: Comanche Compost Co uses specific soils and materials designed to be utilized when the box arrives at your door. We utilize third-party delivery companies to deliver Good Medicine Grow Boxes to customers. Please note that you are responsible for reviewing the Grow Box upon delivery. If you are not home when the Grow Box is delivered, the Grow Box will be left at your door or in a common area. Upon the completion of your review of the Grow Box, we recommend that you place all the soils in an area where they are out of direct sunlight, at room temperature prior to use to keep the integrity of the materials.
Comanche Compost Co. Recommends that all Grow Box instructions found in the Day-By-Day guide be followed, and all ingredients utilized within 6 months of the date it was delivered. This is to ensure that the materials and soils are biologically active and fresh for each stage of growth.
